Question
Mr Anan and friends planned a Songkran holiday in Phuket during April 13-16,2012.They booked a coach for this purpose from a Bangkok bus rental company at 50,000 baht hire and paid a deposit of 10,000 baht at the time of booking.
If the following circumstances had occurred resulting in the frustration of Mr.Anan and friends'plan to Phuket,consider the right and obligations of the parties.
(a) the earthquake on April 12,2012 prevented the coach from travelling to Phuket;
(b) a few minutes before starting out the journey on April 13,2012,the booked coach's engine broke down and the company did not have another coach available.

Answer from one lawyers' opionion
(a)The earthquake is catastrophe which causes the obligation become impossible of performance by cause not attributable to either party. As a result the debtor has no right to receive the counter-performance according to Civil and Commercial Code section 372 and the debtor is relieved from his obligation to perform because the performance become impossible in consequence of a circumstance, for which he is not responsible, occurring after the creation of the obligation. Thus the Bangkok bus rental company does not have to take Mr .Anan and his friends to Phuket and cannot gain 50,000 bath hire. Moreover, the Bangkok bus rental company has to return the deposit of 10,000 baths to Mr.Anan.
(b) The booked coach’s engine broke down; it does not cause the obligation become impossible of performance. The Bangkok bus rental company still has duty to provide another coach from the other company to take Mr.Anan and his friends to Phuket. Unless the Bangkok bus rental company will be liable for any lost. Moreover Mr Anna and his friends have right to rescind the rental contract and can claim the Bangkok bus rental company to return the deposit of 10,000 baths and the 50,000 bath hires.
